Terms of Service

TakeStand ("TakeStand", "we", "us") operates a live audio and video debate platform. By creating an account or using the service, you agree to these Terms.
1. Eligibility
You must be at least 18 years old to use TakeStand. Accounts belonging to minors will be terminated. You are responsible for keeping your login credentials secure.
2. Your Content
You keep ownership of the debates, chat messages, and profile content you post. You grant TakeStand a worldwide, non-exclusive license to host, transmit, record, and display that content so we can operate the service, moderate it, and respond to legal requests.
3. Acceptable use
You may not use TakeStand to post or broadcast:
- Threats of violence, doxxing, or targeted harassment.
- Hate speech targeting protected characteristics.
- Sexual content, nudity, or any content involving minors.
- Spam, scams, impersonation, or platform-manipulation.
- Content that infringes intellectual-property rights.
See our Community Guidelines for the full policy. We may remove content, suspend, or terminate accounts that break these rules — sometimes without notice when there's an immediate safety risk.
4. Sparks and tips
Sparks are a non-refundable, non-cashable in-app credit. See the Sparks Disclosure for the full terms. Tips sent to hosts are final.
5. Host payouts
Hosts who receive tips can request payout under the Payout Terms. Payouts are processed through Stripe and are subject to Stripe's Connected Account Agreement.
6. Recordings
Debates may be recorded and stored so listeners can play them back later. By going live or speaking in a room, you consent to being recorded. If you don't consent, do not enter the room as a speaker.
7. DMCA & copyright
If you believe content on TakeStand infringes your copyright, email dmca@takestand.app with the work, the URL, your contact info, and a good-faith statement. We respond to valid takedown notices and repeat infringers are banned.
8. Disclaimers
The service is provided "as is", without warranties of any kind. TakeStand does not endorse user content and is not responsible for opinions expressed in debates.
9. Limitation of liability
To the maximum extent permitted by law, TakeStand's total liability to you for any claim arising from the service is limited to the greater of $100 or the amount you paid us in the 12 months before the claim.
10. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Disputes are resolved by binding individual arbitration; you waive class actions.
11. Changes
We may update these Terms. Material changes will be announced in-app. Continued use after changes means you accept them.
